Several consumers filed a lawsuit charging that CVS and Express Scripts negotiated “increasingly large rebates” for the EpiPen device from Mylan, which benefited the pharmacy benefit managers and their clients, rather than negotiating lower prices for beneficiaries. As a result, this contributed to the 600 percent price increase over the past decade. The PBMs are accused of breaching their duties under the Employee Retirement Income Security Act.
