STAT MADNESS

(the “Contest”)

By participating in the Contest, you agree to be bound by these Official Rules and the decisions of the sponsor of the Contest, Boston Globe Life Sciences Media, LLC (“Sponsor”), which are binding and final on matters relating to this Contest. The Contest is subject to all applicable federal, state and local laws. 

  1. NO PURCHASE NECESSARY TO ENTER OR WIN. A purchase will not increase your chances of winning. Void where prohibited. Nominee submission in the Contest is open to legal residents of the United States, who are 18 years or older at the time of entry, and that have the authority to nominate and enter on behalf of the university or college (the “Nominator”). Nominees in the Contest must be a United States accredited university or college (an “Institution”) that had a paper published in a 2019 peer-reviewed journal regarding an innovative health or medicine research development made by the Institution (the “Nominee”). Nominees in this Contest must not be a natural person (i.e. an individual). Only the Institution itself may be a Nominee. Nominator will not receive a prize of any kind in this Contest. Sponsor (and each of their employees, parents, affiliates, subsidiaries) and their respective immediate families and household members are not eligible to be a Nominator or Nominee.
  2. TO ENTER. To make a nomination in this Contest, Nominators may, between 12:00:01 a.m. Eastern Time (“ET”) on November 18, 2019 and 11:59:59 p.m. ET on January 22, 2020 (the “Entry Period”), visit https://www.surveymonkey.com/r/stat-madness-2020 (the “Website”) and complete and submit an official registration form (“Entry”). Only up to three distinct innovations (i.e., three (3) Entries) for a single Institution may be submitted for inclusion in the Bracket (as described in Paragraphs 4 and 5). Duplicate Entries and Entries generated by script, macro, other automated means, or by any means which subvert the entry process will be void. Once Sponsor receives an eligible Entry, it may contact the Nominee for verification purposes of any element of any Entry or related materials, the authority of the Nominator to enter on its behalf, and authorization for its participation in the Contest. Without limiting any other provision of these Official Rules, Sponsor will have no liability or responsibility for its inability to contact a Nominee due to the Nominator’s failure to provide, or having provided inaccurate, contact information for the Nominee in the Entry. Sponsor may reject any Nominee for which it cannot properly verify the above information.
  3. ENTRY REQUIREMENTS. Each Entry must comply with the following requirements and makes the following representations:
    1. Provide Nominator’s name and contact information, the Nominee and, where possible, sufficient and accurate contact information within the Institution to enable verification by the Institution of Nominator’s authority to enter on its behalf.
    2. Nominator has the legal authority, rights and permissions to submit the Entry on behalf of the Nominee.
    3. Provide a brief and accurate explanation written by the Nominator, in their own words, of how the innovative research development in health or medicine (the “Innovation”) changes the life sciences. All aspects of such explanation submitted must be originally created and solely owned by the Nominator or Nominee or in the public domain. All third-party content and content unoriginal to Nominator or Nominee is prohibited, unless that content is in the public domain. The Entry may be subject to length restrictions, including word count limitations.
    4. Must be suitable for presentation in a public forum.
    5. Must not infringe, misappropriate, or violate any rights of any third-party including, without limitation, copyright, trademark, trade secret, moral rights, or rights of privacy or publicity.
    6. Must not contain information or content that is false, fraudulent, deceptive, misleading, defamatory, slanderous, libelous (including trade libel), disparaging, unlawfully harassing, threatening, profane, obscene, pornographic, hateful, indecent, inappropriate, or injurious to any Nominator, Nominee, Institution, Released Party, or third-party.
    7. Must not contain or describe any harmful or illegal activity or content or in any way violate any federal, state, or local laws, rules, or regulations.
    8. Include a lawfully submitted .pdf link to the paper published in the peer-reviewed journal regarding the Innovation. Nominator must have the lawful authority and rights to use, copy, distribute, submit, upload, and link to the paper in the Entry. The submission of the paper must not contravene any of these Official Contest Rules, laws or permissions.
    9. Nominator or Nominee agrees to not use the Entry for any purpose other than participation in the Contest.
    10. Nominator or Nominee agrees that submission of Entry and agreement to these Official Contest Rules and any Released Party’s use, display, and publishing of the Entry will not violate any agreement to which Nominator or Nominee, respectively, is a signatory or party.
    11. Sponsor reserves the right, in its sole discretion, to reject, disqualify, or modify any Entries, any element of any Entry or related materials, the authority of the Nominator to enter on its behalf, seek and obtain authorization from a Nominee to place Nominee in the STAT Madness Bracket (“Bracket”), and to disqualify any Entrant whose participation does not comply with Official Contest Rules or may subject the Contest, Sponsor, or Sponsor’s advertisers, clients, or customers to controversy, negative publicity, scorn, and/or ridicule.
    12. Nominator or Nominee (where applicable) agrees to indemnify the Released Parties against any and all claims from any third-party for any use or reuse by any Released Party of the Entry, including without limitation the peer-reviewed journal paper, submitted by such person as is authorized under these Official Contest Rules.
  4. SELECTION OF WINNERS.
    1. Consumer Bracket Selection. Sixty-Four (64) potential winners (each, a “Potential Winner”) will be selected from all eligible Entries beginning on January 223,2020. The Potential Winners will be selected by STAT News editors appointed by Sponsor (“Judges”) using the Judging Criteria described in Section 5. In the event that less than sixty-four (64) eligible Nominees, but at least thirty-two (32) Nominees are entered in the Contest, Sponsor may either (i) select thirty-two (32) eligible Potential Winners using the Judging Criteria or (ii) cancel the Contest. Sponsor further reserves the right to, in the event that less than thirty-two (32) eligible Nominees are entered in the Contest but at least sixteen (16) Nominees, select sixteen (16) eligible Potential Winners using the Judging Criteria or cancel the Contest. The Judges will select the Potential Winners based on the Judging Criteria described in Paragraph 5.Sixty-Four (64) Potential Winners will then be placed by the Judges in first-round match-ups of the Bracket, made public on March 2, 2020. In the event that less than sixty-four (64) eligible Nominees, but at least thirty-two (32) eligible Nominees are entered in the Contest, the Potential Winners will be placed by the Judges in first-round match-ups of the Bracket, made public on March 9, 2020. In the event that less than thirty-two (32) eligible Nominees but at least sixteen (16) eligible Nominees are entered in the Contest, the Potential Winners will be placed by the Judges in first-round match-ups of the Bracket, made public on March 16, 2020. In placing the first-round match-ups and determining which Potential Winners are to be paired with each other in the Bracket, the Judges will rely upon their experience in life sciences, health, and medicine, and to the extent possible, be guided by the following “First Round Match-Up Criteria”:
    2. The similarity between the research categories of the Potential Winners;
    3. The size of the institutions of the Potential Winners; and
    4. The geographic locations of or the existing rivalries between Potential Winner’s Institutions.The First Round Match-Up Criteria is separate and distinct from the Judging Criteria. The application of the First Round Match-Up Criteria in the Contest is limited to this single purpose.
    5. Consumer Bracket Winner Determination. According to the schedule described below, consumers will be able to access the Bracket, populated with the first-round match-ups, on http://www.statnews.com/stat-madness-bracket and participate in the Consumer Bracket voting rounds (the “Consumer Bracket Voting Rounds”).   During each Consumer Bracket Voting Round, consumers will identify the match-up winner(s) for each bracket by applying the Judging Criteria in Paragraph 5 and submitting their votes to Sponsor per the instructions provided on http://www.statnews.com/stat-madness-bracket. At the conclusion of each Consumer Bracket Voting Round, the Potential Winner that receives the most votes for their match-up will advance to the next round on the Bracket (a “Match-Up Winner”). In the event of a tie, the Judges will, applying the Judging Criteria in Paragraph 5, break the tie by selecting the Match-Up Winner.There will be multiple rounds of Consumer Bracket voting, the schedule of which is according to the following:

Consumers must submit their vote identifying Match-Up Winners for each particular Consumer Bracket Voting Round within that Consumer Bracket Voting Round’s timeframe. Consumer Bracket votes will not be accepted for submission once a Consumer Bracket Voting Round has closed. Consumer Bracket submissions generated by script, macro, other automated means, or by any means which subvert the Contest and its processes are prohibited. When cheating is suspected, STAT will pause the contest and open up an investigation. If STAT determines that improper votes have been cast, the corresponding votes will be eliminated from the total number of votes for that entry within that voting round. If it is determined by STAT that the entrant had a role in the casting of improper votes, the entrant will be disqualified. The Potential Winner that progresses to the final round and has the largest total of final Consumer Bracket Voting Round votes identifying it as the overall bracket winner will be eligible to become the official “Consumer Bracket Winner”, subject to the execution and return of an Affidavit of Eligibility and notification by Sponsor. In the event of a tie, the Judges will, applying the Judging Criteria, break the tie by selecting a Consumer Bracket Winner.

  1. Editor’s Choice Winner. Following the tabulation and identification of a Consumer Bracket Winner, the Judges will, applying the Judging Criteria to select an Editor’s Choice Winner among the remaining Potential Winners. The Consumer Bracket Winner and the Editor’s Choice Winner can be the same Potential Winner.
  2. Odds. Odds of winning depend on the number of eligible Entries and Consumer Brackets received.
  3. Notification. The Consumer Bracket Winner and the Editor’s Choice Winner will each be notified by phone or e-mail and may be required to execute and return an Affidavit of Eligibility within five days of date of issuance, or such earlier date specified by Sponsor. If such document is not returned to Sponsor within the specified time period, prize notification is returned as undeliverable, or either the Consumer Bracket Winner and/or the Editor’s Choice Winner is not in compliance with these Official Rules, the Prize will be forfeited and, at Sponsor’s discretion, an alternate Potential Winner may be selected. A Consumer Bracket Winner or Editor’s Choice Winner is not eligible to receive a prize until Sponsor receives Winner’s Affidavit of Eligibility and notifies the Institution that it is a winner. Both the official Consumer Bracket Winner and Editor’s Choice Winner will be announced to the public on Monday, April 6, 2020 on statnews.com.
  1. JUDGING CRITERIA. With the exception of the First Round Match-Up selection, Judges’ decisions will be based on the following criteria (“Judging Criteria”):
    1. Scientific rigor of the work, including the strength of the data and methods used);
    2. Originality and novelty of the Innovation and its methodologies, ; and
    3. Potential beneficial impact of the Innovation in its respective field, the general public, and society overall, and its longevity.
  1. Prizes.
  1. The Consumer Bracket Winner and the Editor’s Choice Winner will receive bragging rights and a mention in an article written by STAT journalists to be published on statnews.com, the timing of which will be at STAT’s discretion but no later than December 31, 2020, detailing the winning Innovations.
  2. General. Neither the Consumer Bracket Winner nor the Editor’s Choice Winner shall have or provide any role (opinion, editorial, Both the Consumer Bracket Prize and the Editor’s Choice Prize (each a “Prize”) is awarded “as is” with no warranty or guarantee, either express or implied, and is subject to availability, blackout dates, and expiration dates. Details of the Prize may change, based on availability. The schedule of implementation for prizing will be in the sole discretion of Sponsor. Sponsor reserves the right to substitute the Prize or portions thereof if Prize cannot be awarded as described. Sponsor will determine all elements of Prize in its sole discretion. Sponsor disclaims all and any liability for the actual provision, quality, or nature of any third party product or service related to the Prize. Sponsor is not liable for injuries, losses, or damages of any kind arising from participation in this Contest and use of the Prize.A prize may not be substituted, assigned, transferred or redeem the Prize for cash by any winner. Each winner is responsible for all applicable federal, state, and local taxes, as well as any other costs and expenses associated with the Prize. A winner forfeits any unused portions of the Prize. The awarding of any Prize is contingent on full compliance with these Official Rules.  If a winner is found to have violated the Official Rules or otherwise does not meet eligibility criteria, that winner will forfeit the Prize and the Prize may be awarded to an alternate winner.
  1. Privacy and Publicity. Each Nominee that consents to its entry into this Contest, except where legally prohibited, consents to be photographed by or on behalf of the Sponsor and permits Sponsor, its parent corporations, subsidiaries, affiliates, agents, and assigns, to use Nominee’s name, likeness, photograph, entry, and any materials Nominator or Nominee submits to Sponsor (“Entrant Materials”), subject to any third-party restrictions identified to Sponsor by Nominee in writing, in all media, throughout the World, in perpetuity, and for any purpose (including advertising, publicity, and/or trade purposes), without notice to Winner and without further compensation.Nominators and Nominees who have consented to entry agree that Sponsor may use the Entrant Materials and any other personally identifiable information collected or used in connection with the Contest in accordance with the privacy policy posted on www.statnews.com.Nominators and Nominees who have consented to entry further agree that Sponsor has the right to use the Entrant Materials in combination with such other material as Sponsor in its sole discretion shall determine, and that Entrants have no right of approval, claim to compensation or benefits claim, including without limitation, claims based upon invasion of privacy, defamation, or right of publicity arising out of any use of Entrant Materials.
  1. RELEASE. Released Parties (as defined below) are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, undelivered, or garbled entries or email for whatever cause or other errors whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by Website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Released Parties are not responsible for injury or damage to participants’ or to any other person’s computer related to or resulting from participating in this Contest or downloading materials from or use of the Website. Persons who tamper with or abuse any aspect of the Contest or Website, who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated Entries will be void. Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Contest at any time and for any reason, including, but not limited to, if any portion of the Contest is, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of Entries, and, if terminated, Sponsor may select the Potential Winner in a random drawing from among all non-suspect, eligible Entries received for such drawing prior to action taken or as otherwise deemed fair and appropriate by Sponsor.By participating, each Nominator and each nominee that has consented to entry agrees that Sponsor, suppliers of the Prize, and their respective parents, affiliates, subsidiaries and advertising and promotion agencies and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”) will have no liability whatsoever for, and shall be held harmless by Nominator and nominee against, any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the entry, Entry Materials, prize or participation in this Contest. In the event of a dispute regarding Entries received from multiple users having the same e-mail account, if applicable, the authorized subscriber of the email account at the time of entry will be deemed to be the Nominator and must comply with these Official Rules. Authorized account subscriber is the natural person who is assigned the e-mail address by the internet service provider (ISP), online service provider, or other organization responsible for assigning e-mail addresses.Any and all claims, judgments and awards will be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Contest but in no event attorneys’ fees and under no circumstances will any Nominator or Nominee be permitted to obtain awards for, and hereby waives all rights to claim, punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
  1. GOVERNING LAW/JURISDICTION. The Contest and these Official Rules are governed by and shall be construed in accordance with the substantive laws of the Commonwealth of Massachusetts (as distinguished from the choice of law rules) and the United States of America applicable to contracts made and performed entirely in Massachusetts and where the relevant contacts are with such state. Except where prohibited, as a condition of participating in this Contest, Nominators and Nominees agree that any and all disputes, claims and causes of action arising out of or connected with this Contest, the prizes awarded, or the determination of the Winner shall be resolved individually, without resort to any form of class action. Nominators and Nominees further agree that in any cause of action, the Released Parties entire liability will be limited to the cost of entering and participating in the Contest, and in no event shall the Released Parties be liable for attorneys’ fees and/or experts’ fees and costs. By entering, Nominators and Nominees waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages and further waive all rights to have damages multiplied or increased.
  1. WINNER’S NAME. For the name of the Winner(s), send a self-addressed stamped envelope to: STAT Madness, Attn: Britt Whitmore, c/o Boston Globe Life Sciences Media, LLC, 1 Exchange Place, Ste 201, Boston, MA 02109-2132. Requests for Winner names must be received no later than 60 days from the announcement date described in paragraph 4.
